Terms of Service

These terms apply to MetElkaarOnline. By using the service you agree to them.

Private beta and service status

MetElkaarOnline is currently a private beta under active development. The production environment currently collects no real subscription payments, and existing free or test access is not automatically converted into a paid agreement.

Before live paid subscriptions are enabled, we will publish the complete business and registration details, payment provider, price, billing period, renewal and cancellation information, and the applicable consumer rights.

The service

MetElkaarOnline is a private space for partners, housemates, and small households to manage notes, tasks, calendars, and household information together.

You may only use the service for lawful, personal purposes. You are responsible for the content placed in your group.

Account, group, and access

You are responsible for keeping your login details, recovery codes, and devices confidential.

You may not create an account with false information or use the service to harm, harass, or mislead others.

You can delete your own account after leaving your groups or after the relevant group has been deleted. A group-wide deletion may require consent from all group members because it also permanently removes shared data belonging to other members. That shared consent prevents one member from unilaterally deleting other people's shared data.

Content, encryption, and recovery code

Group content is stored encrypted. In the standard setup, we cannot read or decrypt the original group content for you. Development Feedback is a separate opt-in exception that is only enabled when all group members consent.

You remain the owner of your content. By using the service you only grant us the rights needed to deliver it technically, such as storage, security, and operational backups.

The group-content recovery code is part of this security model. If nobody retains a valid key, signed-in device, or recovery code, the encrypted content can technically become unrecoverable. This is not a blanket exclusion of liability and does not affect rights or liability that cannot be excluded by law.

Subscriptions, renewal, and cancellation

The production environment currently does not sell or collect payment for any real paid subscriptions. Premium may be enabled for testing during the private beta without a real charge.

If live paid subscriptions are enabled later, the service must clearly show before purchase the price and billing period, whether and how the subscription renews automatically, how to cancel, when cancellation takes effect, and which statutory withdrawal, refund, or other consumer rights apply. We will update that information and these terms before live billing is activated.

Free or test access will not become a paid subscription without an explicit action by the user.

Availability

We aim for a stable service, but do not guarantee uninterrupted availability. Maintenance, outages, or force majeure may temporarily limit the service.

We may change or end features when reasonably necessary for security, law, or product development. For material changes, we will take applicable statutory user rights into account.

Liability

Nothing in these terms limits liability or consumer rights where the law does not allow such a limitation. Free use therefore has no contractual €0 liability cap.

Where a limitation is legally permitted, we limit liability to reasonably foreseeable direct loss attributable to MetElkaarOnline. Indirect or consequential loss is excluded only to the extent permitted by applicable law.

The technical risk remains that encrypted content cannot be decrypted when every valid key, device, and recovery code has been lost. That technical consequence is not a waiver for intent, gross negligence, or other liability that cannot legally be excluded.

Privacy

Our privacy policy explains how we process personal data, where the core environment is hosted, and how operational backups are retained. That policy forms part of these terms.

Applicable law and contact

These terms are governed by Dutch law, insofar as mandatory consumer law does not require otherwise.
